What is ZBA?
The ZBA, or Zoning Board of Appeals, is a group of members within Clay, that decide if property owners who apply for a variance - permission to deviate from the zoning ordinance - can or cannot go against what the zoning ordinance allows them to do. The ZBA members review the property and request and make their own decision on approving or disapproving the variance request.
Filled out and completed applications, the $450.00 fee, and all required documents must be submitted to the Building Department before being placed on the ZBA’s agenda. The date of the ZBA hearing will be established after review of application and supporting documents. At this hearing, you must appear in person or be represented by an agent or attorney. Prior to the meeting, notices from the Zoning Board of Appeals will be sent first-class mail to all property owners within a radius of 300 feet of the property requesting variance approval. As well as a notice of the requested variance published in a qualified newspaper fifteen days prior to the Zoning Board of Appeals meeting date. If your variance is approved, building permits will be issued through the building department.
